Compensation for Children Injured on Bouncy Castles
Children of all ages love bouncy castles and inflatable slides, and when they are taking part in such fun activities on days out and on holiday, it doesn’t normally cross parents’ minds that they may be in danger in any way.
Case Study: Child Injured in Accident on Holiday
Mr and Mrs P contacted our firm following an accident while they were on holiday in Wales. They were visiting a family fun day at a local farm, and their five-year-old son decided to use the bouncy castle. While he was on the bouncy castle, because it had not been properly secured, a sudden gust of wind blew it up in the air and onto its side.
The child was thrown from the bouncy castle onto the ground. Mrs P called an ambulance and her son was taken to the local hospital where x-rays confirmed a fracture to his right arm. The accident occurred only three days into a two-week holiday, and the family were too upset to stay and decided to return home.
Mr and Mrs P’s child was in pain for a considerable amount of time after the accident. He had only just started school, and when he returned after six weeks he seemed to have lost a lot of confidence and did not want to play with the other children. The injury also impeded his ability to write, and it took significant time for his handwriting to catch up with his peers.
Our Legal Advice
Bartletts arranged for the child to be seen by an orthopaedic specialist in children’s injuries, as there was concern about the possibility of long-term damage. Thankfully, he went on to make a full recovery from the injury.
Our solicitors wrote to the owner of the inflatable castle and obtained an admission of liability from their insurers. The child received £3,000 compensation (invested in a court funds account until he reaches the age of 18). In addition, we recovered damages for loss of enjoyment of the holiday, and the family then enjoyed another holiday later in the year when their child had fully recovered.
