Mr T was walking along on the pavement on a London street, when he was struck on the back of the head by the wing mirror of a Transport for London bus that was driving up from behind him, and knocked to the ground. Other pedestrians came to his assistance and he was taken to hospital, where he required stitches for a cut to the head and was diagnosed with a bad concussion. He was kept in overnight for observation and discharged the following day, but continued to experience headaches for a week afterwards, and was forced to take 10 days off work.
The bus had not stopped following the collision with Mr T, and following his complaint, Transport for London refused to accept responsibility for the incident. Based on their lack of response, and the injury and loss of earnings that the accident had caused, Mr T decided to seek legal advice.
