Mr T was visiting a pub to meet a friend and was walking back to his table from the toilets, when he stumbled in a crowded area and fell over, sustaining deep lacerations to his hands in an attempt to break his fall.
There was a pile of broken glass on the floor that had been clustered together by a member of the pub’s staff, but had not been removed from the bar area. Mr T was given basic first aid treatment at the scene, but as his hands were bleeding profusely, his friend decided to drive him to hospital.
Mr T needed multiple stitches in both hands, injuries which kept him off work for two weeks, and which doctors advised him were likely to leave long-term scarring. Despite his written complaint to the pub’s parent company, a major pub chain owner, Mr T was not offered any form of compensation for the injuries he had suffered, and so decided to seek a legal opinion on his situation.
Solicitors Claiming Compensation for Cuts From Broken Glass in Pubs
Bartletts Solicitors went on the represent Mr T in a no win no fee personal injury claim against the pub and bar operator in question, and wrote to them outlining the circumstances surrounding the accident.
As establishments open the public, pubs are regulated by the Occupiers Liability Act 1957, meaning that the owner or occupier owes a duty of care to visitors to the premises, and must take all reasonable measures to prevent accidents from occurring.
In this instance, the pile of broken glass on the floor represented a foreseeable risk to anyone visiting the establishment and should have been cleared away at the earliest opportunity.
We obtained witness statements confirming that the broken glass had been left on the floor for at least half an hour before the accident, despite staff at the pub being aware of it. This amounted to negligence for which the owner of the establishment was ultimately liable. Mr T received £3,750 in compensation.
