What Is Housing Disrepair?

Your landlord has various duties to keep your home inhabitable, safe, and in good repair. The extent of their obligations should be detailed in your Tenancy Agreement, so our housing disrepair solicitors will begin by reviewing the terms of that agreement to establish whether their duties cover the disrepair you wish to claim compensation for.

Even if the specific disrepair you are experiencing is not covered by the Tenancy Agreement, your landlord has several obligations imposed by law. For example, whatever your Tenancy Agreement says, your landlord is always obliged to repair the following:

  • Electrical wiring
  • Gas appliances
  • Pipes and drains
  • Structural issues
  • The exterior of the property.

Before you commence a housing disrepair claim, you must have notified your landlord of the issue and given them a reasonable time to carry out the repairs. What will constitute a ‘reasonable’ time depends on the nature of the repair and its urgency. For example, if your heating system breaks down in the middle of winter, it might be reasonable to expect the landlord to act within 24-48 hours. For non-urgent, routine repairs, a reasonable time will likely be around 14 days.

Martin – Thank you so much for all you have done for me and making my claim successful. I will always be very thankful for what I have received. Once again many thanks

How Is Housing Disrepair Compensation Calculated?

Compensation in housing disrepair claims is legally known as ‘damages’. There are two distinct types of damages, known as ‘special’ and ‘general’.

General damages are intended to compensate you for the distress and inconvenience caused by having to live with the disrepair. Since each case and sufferer is unique, so too is the level of general damages you can expect. However, the damages award is usually based on the amount of rent you paid for the property during the period of disrepair. The overall rent is then adjusted to reflect the severity of the issue. The worse the state of disrepair, the higher the percentage of the rent you can expect to recover.

Special damages are intended to make good any out-of-pocket expenses you have incurred as a result of the disrepair. These expenses might include increased heating bills if the issue meant you were forced to have the central heating on more than expected.

What Evidence Do You Need To Support Your Housing Disrepair Compensation Claim?

How much compensation for housing disrepair depends largely on the evidence you have to support your case. The more evidence you can produce, the stronger your case will be. Examples of the types of evidence that may assist you include the following:

  • Photographs of the disrepair
  • Photographs of any personal property or belongings damaged by the disrepair
  • Your Tenancy Agreement
  • Correspondence between you and your landlord relating to the issue. You should put your complaints in writing wherever possible and follow up any conversations with an email
  • Medical reports if the disrepair caused you to suffer physical or psychological harm
  • Evidence of any out-of-pocket expenses you incurred as a result of the disrepair, such as increased heating bills.

What Is A Housing Disrepair Claim?

A housing disrepair claim is a claim brought by a tenant against their landlord in circumstances where the tenant has notified the landlord of a disrepair issue and the landlord has failed to fix it in a reasonable time. Not all disrepair matters give rise to a legal claim, but at the very least, your landlord is legally obliged to ensure that your home is fit for human habitation.

Examples of the types of issues that might give rise to a housing disrepair claim include the following:

    • Damp.
    • Mould.
    • Gas leaks.
    • Vermin infestations.
    • Faulty electrics.
    • Missing roof tiles.
    • Subsidence.

You cannot bring a housing disrepair claim until you have notified your landlord of the disrepair and allowed them a reasonable time to remedy it. The definition of ‘reasonable’ depends on the circumstances of the matter. For non-urgent repairs, a period of 14 days will generally be considered reasonable. In more urgent cases, such as dangerous electrics, your landlord should act much quicker. If you notify your landlord of the issue and they fail to carry out the necessary repairs, you can issue a housing disrepair claim against them.

What Remedies Are Available In Housing Disrepair Claims?

If you bring a housing disrepair claim against your landlord and succeed, the Court may order the landlord to complete the necessary works by a specified date and pay you compensation. If your landlord fails to complete the works by the deadline, the Court may order them to pay additional damages and place a ‘penal notice’ on the Order. If your landlord still does not undertake the works by the new date stated in the Order, you would be at liberty to bring contempt proceedings against them, which could result in the landlord being imprisoned.

In Court proceedings, the compensation you receive is known as ‘damages’. There are two types of damages: general and special.

The purpose of general damages is to compensate you for the distress caused by the disrepair and the inconvenience of having to live with it. General damages are based on the rent you pay for the property, adjusted to reflect how severe the disrepair is. The worse the disrepair, the higher the percentage of rent you will likely recover.

By comparison, the purpose of special damages is to make good the financial losses you have incurred as a result of the disrepair. For example, if your heating bills have increased because of defective windows, you should be able to recover the additional expenditure you incurred.

It is worth noting that many housing disrepair claims are settled without the parties having to go to Court. Sometimes, cases are resolved before the tenant even issues a claim, through negotiation or alternative dispute resolution methods such as mediation.

Martin – Thank you so much for all you have done for me and making my claim successful. I will always be very thankful for what I have received. Once again many thanks

How Much Compensation Can You Claim For Housing Disrepair?

What is housing disrepairWhen you rent a property, it becomes your home – and your home should be a comfortable, safe place to be. If this hasn’t been your experience and your landlord has ignored your complaints about any housing disrepair issue in your home, you might be eligible to make a claim for compensation.

      When Can You Claim?

Your landlord has a legal duty to ensure the property you rent from them is of an acceptable standard. If it isn’t and you’ve informed them about the matter, then you can make a claim.

As a guide, you will be able to claim compensation in the following situation:

      • Your home has worsened significantly since the time you moved in
      • You have notified your landlord in writing of the issues
      • You have given your landlord reasonable time to remedy the situation
      • Your landlord has failed to carry out the necessary repairs to your home

      What Can You Claim For?

You can claim for the suffering and stress caused by the disrepair. This includes any physical impact the level of disrepair had on your health and wellbeing, the inconvenience of having to move out if you had to vacate the property, as well as any damage to your possessions as a result of the housing disrepair.

How Much Housing Disrepair Compensation Can You Claim?

When you make a housing disrepair claim, the amount you are awarded depends on the length and severity of the disrepair, as well as the impact it has had on you and the members of your household.

The pain and suffering caused by living in a home in a state of disrepair, will be factored into your compensation amount, as will whether you had to move out of your property because of the disrepair.

As a guide, the following factors influence how much compensation you receive:

      • The rent you paid while living with disrepair issues
      • Length of disrepair
      • Severity of disrepair
      • Impact on your health and wellbeing
      • Impact on your household’s health and wellbeing
      • If you had to move out

The rent you pay is used to calculate the compensation amount. You will be awarded a percentage of the rent you paid while your home was in a state of disrepair. This applies even if your rent is paid by the local council in the form of housing benefits and you can still claim compensation.

The percentage of rent paid depends on the severity of the disrepair. If your home is totally uninhabitable, you will receive 100% of the rent paid. However, this is rare and usually it is between 25% and 50% of the rent paid for the property during the period of disrepair.

Will Disrepair Claims Rise in the Future?

The number of disrepair claims against housing associations is expected to rise significantly following a coroner’s ruling that the death of Awaab Ishak from a respiratory illness was caused by ‘chronic exposure to mould’ in the Rochdale Boroughwide Housing (RBH) flat where he lived.

National press coverage of the health risks posed by damp and mould is making more tenants aware of the steps they can take when a landlord fails to deal with the problem. Many reports highlight the difficulties tenants face when they try to get landlords to address disrepair issues, including failures to respond to complaints and long delays in repair work being carried out. In the meantime, tenants are being forced to endure unacceptable living conditions for periods of many months or even years.

Other reasons for the increasing number of disrepair claims against housing associations include a lack of funding and decades of underinvestment in council housing stock and maintenance and reporting procedures, as well as the cost of living crisis, particularly soaring energy bills, which means damp and mould spreading in underheated homes across the country.

When a landlord makes no effort to repair a damp and mould problem, tenants have few options apart from making a housing disrepair claim. The Homes (Fitness for Human Habitation) Act 2018 requires all landlords to maintain their properties to meet the minimum standard for human habitation, and gives tenants the power to take legal action if they believe their property is unfit for human habitation.

Our housing disrepair solicitors are sympathetic to the physical and emotional problems caused by landlords who let out substandard housing, and are experienced in disrepair claims against housing associations:

      What Is Housing Disrepair?

In an ideal world, our homes would be immaculate and issue-free but reality means that problems do arise – and when they happen, who is responsible?

The legal owner of the property is ultimately responsible and is duty bound to rectify any issues and fix any damages. This is why housing disrepair claims only ever happen between tWhat is housing disrepairenants and landlords – arising when the tenant has waited too long for a problem to be resolved due to the landlord’s refusal to take action.

If your landlord has had a reasonable amount of time to repair the damages to your home and has not, then you may be entitled to make a claim for compensation.

      What Is Housing Disrepair?

Housing disrepair covers a range of issues and isn’t just limited to the inside of your home – it is any issue that either causes a safety risk, threatens your health and wellbeing, or causes inconvenience to your daily life.

As a guide, housing disrepair usually falls into one of 3 categories:

      Property damage

Any damage to your property that you have notified your landlord about that has not been repaired, is considered to be housing disrepair.

Examples of damages include dampness on the walls or condensation on the windows, plumbing problems, or loose floorboards.

Damages can lead to safety risks and your home could become an unsafe place to live.

Always contact your landlord as soon as you notice any property damage, and your landlord should communicate with you and arrange for the repairs to rectified.

      Outside damages

Damage to the outside of your home or to your garden is classed as housing disrepair.

It may be that the fence in your garden is damaged or your drains are blocked – whatever the issue is, you should expect your landlord to take action soon after being told about the matter.

      Inconvenience

Your home may be structurally safe but you may have an infestation of mice or rats. This can often be a sign of damage to the property somewhere unseen and obviously is not nice to live with.

Your landlord should react straightaway after being told there are pests in your property, to resolve the matter.

How We Can Help You With Your Housing Disrepair Claim?

What Is a Defining Moment for Housing Associations?

The tragic death of Awaab Ishak at his family’s housing association property in Rochdale in December 2020 has been labelled a ‘defining moment’ for the housing sector at the child’s inquest, with the government further stating that providers are being put ‘on notice’. This includes Rochdale Boroughwide Housing (RBH), the housing association responsible for the home where Awaab died from ‘chronic exposure to mould’.

The inquest concluded that the two-year-old’s death was the result of a severe respiratory condition caused by prolonged exposure to damp and mould at his home on the Freehold estate in Rochdale, ultimately leading to respiratory failure. The property was judged to be inadequately ventilated, which was a prime reason for excess damp, condensation and mould spreading, and was also described as ‘unfit for human habitation’ by experts.

The inquest heard that no action had been taken by RBH to treat and remove the mould, despite the child’s parents having reported the disrepair issue three years before Awaab’s death. Concerns had also been expressed by health professionals that mould at the property could have an impact on the child’s health, but this similarly failed to lead to repair work being undertaken by the housing association.

Conditions at the family’s home do not appear to be unique, with Sky News revealing that RBH has received 106 formal complaints from tenants about damp and mould in their properties over the last 12 months. This may considerably underestimate the scale of the problem according to a former RBH employee who spoke to Sky, but it is clear that damp and mould poses an ongoing health risk to numerous housing association tenants, not only on the Freehold estate, but all across the country.

If you feel that your health or safety or comfort has been compromised and put at risk, you should contact your landlord straightaway so that he or she can take the necessary action.

Your landlord has a legal duty to keep the property in a safe condition for the tenant and is obliged to repair or replace any faults as soon as possible, and always within a reasonable amount of time after being notified.

Usually, landlords will work to fix the issues once informed by their tenants – but unfortunately this isn’t always the case.

What Happens If Your Landlord Ignores Your Complaint?

Depending on your experience and circumstances, if your landlord has been neglectful of your ongoing issues with your rented home then you may be eligible to make a claim against him or her.

As a guide, you can usually claim for one of the following reasons:

      • Mould or Damp
If there is mould or damp in your property that your landlord won’t help to fix, you can usually claim compensation for any damage to your belongings caused by the damp living conditions. Make sure you take photos of the damaged items as proof and keep safe any receipts of items that you have had to repair or replace because of the mould.
      • Poor Health
If the housing disrepair has had a bad effect on your health, then you may be able to claim for compensation. The amount you would receive would depend on how ill you have been and for how long, and whether or not you have had to miss work as a result of your ill health.
      • Inconvenience
Even if your housing disrepair has not damaged your belongings or your health, it might have caused you inconvenience and discomfort which is not fair either. How We Can Help You With Your Unfit Housing Claim

Our housing solicitors have successfully handled numerous claims for compensation against negligent landlords and are here to help if you have been living in unfit housing as a result of your landlord’s refusal to take action.

Only recently, our team in our Chester office were able to help a local family of five (mum, dad and three children) claim for compensation after living as tenants in rented accommodation owned by a local housing association. Despite making complaints for 3 years about the damp in the property, the landlord did nothing. As a result of this, everyone in the family suffered from ill health due to the damp conditions, and their possessions were damaged too.

Together with our help, the family claimed compensation for the loss of use and inconvenience of living in unfit housing conditions plus for damaged property and ill health. In total, dad was awarded £6,000, mum £1,750, the two children still living at home £1,100, and the child who had moved in with their grandparents as the mould was so bad in their bedroom received £400 in compensation.

Bartletts Chester Helps Local Family Claim Compensation For Years Of Living In Unfit Housing

A local family who suffered for more than 3 years because of unfit housing conditions have been awarded compensation after making a claim with the help of Bartletts Solicitors in Chester.

The housing disrepair case was brought to the specialist team at Bartletts Chester who worked hard to secure the compensation for all five family members – mum, dad, and 3 children.

The family were tenants in rented accommodation owned by a local housing association. Despite making complaints for 3 years about the damp, unfit living conditions of the property, the landlord took no action to remedy the problems until Bartletts Chester got involved.

The entire house was affected by mould because of the damp conditions, and one child moved out to live with their grandparents as the mould in their bedroom was unbearable. As a result of the damp, the remaining family members were ill on and off for the 3 years, and their possessions, including furniture and clothing, were badly affected by the damp too.

The dad, a health and safety officer, and mum, the couple’s disabled child’s carer, got in touch with the personal injury lawyers at Bartletts Chester who were able to prove that the significant coughs, colds and respiratory problems all the family members had been suffering from during the 3 years were over and above the usual seasonal illnesses.

A claim was made on the family’s behalf for the loss of use and inconvenience of living in unfit housing conditions, which is calculated as a percentage reimbursement of the rent per calendar month, plus for damaged possessions, and for the illness suffered by each family member over the years.

In total, dad was awarded £6,000, mum £1,750, the 2 children still living at home £1,100, and the child who had moved out received £400 in compensation.

As soon as the repair works were carried out at the house, the family stopped suffering from the illnesses caused by damp housing.

This was an interesting case as housing repair law recently changed following the implementation of the new Housing Act 2018 from March 2020. The change in law has opened up claims for tenants who may have previously struggled to secure compensation for issues such as condensation problems – before, condensation was deemed to be the tenant’s fault but now it is judged on a per-case basis and is often seen as being caused by the landlord failing to insulate the property properly.
