Ms K had an electrolysis treatment carried out on areas of her face that left her with bruising and a scar on her chin. The machine that the beauty technician was using was not working properly, and she used too much pressure when applying it to Ms K’s face, causing bruises on her skin. The electrolysis treatment failed to remove the intended areas of hair, and also damaged Ms K’s skin, leaving her with scar tissue on her chin, representing a small, but most likely permanent blemish on her face.
She complained to the salon where the procedure was carried out, but was only offered apologies and a refund. Due to the pain and suffering she had endured as a result of their errors carrying out the electrolysis, Ms K could not accept that this was enough, and felt she was left with no other option but to seek legal advice.
Our Legal Advice
Ms K subsequently instructed Bartletts Solicitors to begin a compensation claim against the beauty salon for the injuries caused by her bungled electrolysis treatment. On behalf of the claimant, we contended that the technician performing the treatment had acted negligently, both by failing to use the electrolysis machine in a competent manner, and by failing at the same time to notice the damage that it was doing to Ms K’s face.
The salon was also poorly supervised, and the technician in question, by her own admission, had limited experience in carrying out electrolysis treatments on facial areas. After a few months of correspondence with the salon’s insurers, we were able to reach agreement on a compensation settlement totalling £4,250, of which Ms K kept 100%, under the terms of her no win no fee agreement with Bartletts.
