Mr G was spending the evening at a popular nightclub in his hometown when he was injured and left with permanent scarring after being cut by broken glass. Mr G was crossing a poorly lit area of the nightclub when he lost his footing and fell forwards onto the hard floor, landing on an empty bottle of spirits that had been previously discarded by a nearby table of revellers.
The bottle smashed against his shoulder on impact, with a large shard cutting into his upper arm and leaving a deep and jagged wound. Mr G was subsequently taken to hospital by ambulance and passed out during the journey due to loss of blood. The hospital later confirmed that Mr G had not been drinking excessively on the night in question and that his senses were therefore not impaired at the time of the accident. He required almost 20 stitches in his arm, and was left with a thick scar that he was told by doctors would never disappear completely.

Having requested and received details of the inspection and cleaning procedures at the nightclub, we contended that inspections in certain areas of the venue were insufficiently regular, and that on the night of the accident the nightclub was full to capacity, yet did not have sufficient numbers of staff on duty to effectively identify and deal with hazards within a reasonable timeframe. Within a few months of initiating the claim the nightclub accepted liability for the accident, and Mr G received personal injury compensation totalling £3,250.
