Bartletts Solicitors Wrexham office help pensioner knocked down by delivery van

When a pensioner was knocked down by a delivery van when shopping, Bartletts personal injury solicitors in Wrexham helped him get back on his feet and secured him the compensation he deserved.

The 80-year-old gentleman was visiting his local high street to do a bit of shopping, and was crossing the road using the pedestrian crossing, when a large delivery truck knocked him over. The driver had failed to observe the Highway Code rules for pedestrian crossings and failed to stop his vehicle. The truck collided into the gentleman who was crossing, who was knocked down at force to the road.

An ambulance was called to the scene by passers-by and the pensioner was taken to the accident and emergency department of the local hospital. He was examined and x-rayed, and diagnosed with a serious set of personal injuries including a broken leg, soft tissue damage, and was in severe shock. His broken leg was set in plaster.

Given the nature of his injuries, the gentleman stayed in hospital for a few days to recover and get over the shock of the accident.  Once his leg had mended, he was still suffering a considerable amount of ongoing pain, so he was given a course of physiotherapy sessions to help him get mobile again.

The gentleman came to see one of Bartletts’ experienced personal injury solicitors in Wrexham, on recommendation from a member of his family. Our personal injury lawyer quickly set about contacting the van driver’s insurance company and establishing his claim for personal injury compensation.

Bartletts then skilfully negotiated a settlement figure that reflected the level of pain and suffering the gentleman had endured, as well as compensation for the care and assistance he had needed since his accident.

Bartletts Solicitors in Wrexham help man struck on head by shop sign

When a shop sign fell on a young man, leaving him permanently scarred, Bartletts personal injury solicitors in Wrexham helped him win compensation for personal injury.

The young man, who was in his 20s, was walking across a car park to his car, when a swinging shop advertising sign fell off its hinges and landed on him. The sign was of considerable weight, and as it fell from height it hit the man’s head with a great deal of force. The man fell to the pavement, his head was bleeding profusely and he was in a lot of pain.

The young man went to the accident and emergency department of his local hospital, where the cut to his head was examined and stitched. He was left with a scar on his forehead near to the hairline. He was unable to return to work for a few days due to concussion and swelling to his head and was prescribed some strong painkilling medication. He also needed a course of physiotherapy to alleviate some neck pain which also resulted from the accident.

When the young man came to see one of Bartletts specialist personal injury solicitors, he had a permanent scar at the site where the sign had landed on his head. Our experienced lawyer contacted the shop’s insurance company on his behalf and got to work on establishing his claim for personal injury compensation.

Bartletts successfully secured a settlement for the young man, as compensation for his personal injury, physiotherapy, medical costs and compensation for his loss of earnings.

Compensation for finger trapped in escalator

Supermarkets are renowned for being busy places and full of common hazards such as sliding doors and escalators. However, when a hazard has been reported to staff and no action is taken, an accident in a supermarket is just waiting to happen. This is just what happened to one gentleman who came to see Bartletts specialist personal injury lawyers in Chester.

The 64-year-old pensioner was visiting his local supermarket, and travelling on the travellator from one level to another when his finger was caught in a side panel that had come loose. He had come to no serious harm, but out of concern for other shoppers he reported the problem to the supermarket staff and then went on with his shopping.

Two weeks later, he returned to the same supermarket and used the same travellator, and again he got his finger caught in the missing panel of the escalator. This time, the speed of the travellator meant that the tip of his finger was sliced off, and started to bleed profusely.

He went to the accident and emergency department of the local hospital, who dressed and treated the wound. It took nearly six weeks to heal, but left him with permanent deformity to the top of his finger and some ongoing loss of sensation.

When the gentleman came to see Bartletts Solicitors, he was concerned that the supermarket had taken no action after he had initially reported the hazard, and put him and other shoppers in danger.

Our expert personal injury solicitor quickly set to work and established that the supermarket had failed in their duty of care to make sure the gentleman was safe while he was on their premises.

Bartletts Solicitors in Chester secured a good level of compensation for the gentleman to reflect compensation for personal injuries and compensation for out of pocket expenses, as well as sending a message back to the supermarket to take better note of customer’s safety concerns in the future.

How will you pay your bills if you are injured or have an accident?

If you are injured in an accident, leaving you unable to work, you may naturally be worried about how you will continue to support your family and pay your household bills. As part of our comprehensive service, Bartletts personal injury Solicitors in Chester could arrange for an interim compensation payment to help you with your outgoings and expenses, while you recuperate.

We recently helped a 35-year-old factory operative who had been injured at work, secure interim compensation payments from his employer. The gentleman slipped on some liquid which had been spilt on the floor by a colleague, and bumped his already injured shoulder against a wall.

The fall aggravated an existing injury to his left shoulder joint, and left him in need of surgery to repair the problem. When he came to see one of Bartletts expert personal injury lawyers, the gentleman had just been diagnosed and was concerned that he would need to be off work for some time following the surgery, which would leave him and his family out of pocket.

Our tenacious lawyer, advised him to claim compensation for personal injuries and compensation for loss of earnings from his employer. Employers are vicariously liable for the actions of their employees, and also have a duty of care to make sure their employees are safe while they are at work.

We contacted the employer and quickly established the gentleman’s personal injury claim.  Once liability had been admitted by his employers insurance company we then secured interim payments to make sure his monthly financial commitments were being met while the long term compensation claim was being settled.

This allowed the gentleman to have the surgery he needed without financial worries, as well as a course of physiotherapy afterwards to fully rehabilitate him and get him back to work.

Bartletts then negotiated with his employer’s insurance company to secure a final compensation figure. As a result they paid for his arthroscopic surgery and follow up physiotherapy treatment, as well as loss of earnings, out of pocket expenses and a generous compensation for personal injuries.

Are You Prepared To Become A Centenarian?

Do you want to live to 100? Your 100th birthday may seem a long way off or even an unlikely outcome, but with a third of babies born today expected to live to 100 and beyond it’s vital to be prepared for this milestone.

Living to 100 is definitely worth celebrating but there are also a lot of things you should be prepared for, including the practical and financial consequences of living for a century. Planning for your wellbeing, today, will give you the peace of mind that you, your family and your finances will be looked after in the future.

An estimated 500,000 of us are set to become centenarians by 2050, according to the Office for National Statistics. If you’re one of them, will you be prepared?

Matters To Consider

There are numerous consequences of living for 100 or more years, so it’s important you start planning now. If you’re prepared for this big birthday, you’ll enjoy it all the more – and ensure you and your loved ones are taken care of before and afterwards, also.

Personal Matters

You can make legally-binding decisions now for the future, in the form of a living will or through a Lasting Power of Attorney. These decisions enable you to choose how you spend your final days, including the treatment you receive and where you want to die, be it at home or in a hospice.

Legal Matters

By appointing a Lasting Power of Attorney, loved ones will be able to make decisions for you if you become mentally unable to do so in the future. This can include your health, welfare and financial situation, and makes it much easier for loved ones to take care of you and carry out decisions on your behalf – otherwise, without one, your family would have to apply to the Court of Protection to decide who should make these important decisions for you, which involves costs and stress at an already stressful time.

Financial Matters

As most of us retire in our 60s, living to 100 means there will be a lot of retirement years. How will you fund these years? As well as planning for your lifestyle during these lengthy post-work years, you may want to support family members such as grandchildren too, so it’s worth taking the time to plan your finances.

Tax is an important part of the planning. Monetary gifts to loved ones may not be subject to inheritance tax if you survive for a further seven years, and this is on top of your annual personal allowance for tax free gifts. These inheritance tax allowances can make a big difference to the lives of family members so it’s vital you seek professional advice for planning your retirement – for you and your loved ones’ benefit.

As a result of living longer, more of us will need professional care in the future. There are steps you can take now to protect your home so you can pass it onto your children and ensure it isn’t used to pay for your care fees. There are many different things to think about when planning for your finances in the future, but doing so ensures you’ll be looked after, as will your family, and in the most tax-efficient way.

Will Matters

A will ensures your wishes are carried out and loved ones cared for after you’ve gone. Living to 100 may mean living a more complicated life, such as remarrying or living with a different partner. This can increase the risk of inheritance disputes and dying without a will means your estate is divided according to the rules of intestacy rather than your wishes. By writing a will, you also have control over your funeral arrangements as well as other important matters such as what happens to your pets after you’ve gone, as all these can be detailed within the will.

With so many things to consider, why not prepare yourself today for your 100th birthday in the future? This way, you’ll make all the consequences of becoming a centenarian much easier for all and give yourself the peace of mind to really enjoy life without the worry of how you’re going to take care of yourself and loved ones as you grow older.

Why Lasting Powers Of Attorney Are Not Just For The Elderly

While many individuals may think of the elderly when they think of a Lasting Powers of Attorney (LPA), this powerful legal document is not only relevant for those suffering from cognitive decline such as dementia but LPAs are also invaluable for younger people too, as mental and physical incapacity can strike at any time following an accident or illness for example.

This is why you should plan ahead when it comes to LPAs, as it eases the potential strain on family and friends should you lose capacity in the future. Without an LPA in place, your chosen Attorney(s) would have to apply to the Court of Protection to gain access to your finances and to be able to make decisions relating to your healthcare, which can be time consuming, stressful and costly.

Lasting Powers of Attorney – What Exactly Is An LPA?

A Lasting Power of Attorney is a legal document that provides another individual with the legal power to make decisions on your behalf. This may include managing certain or all aspects of your financial matters and/or health and welfare decisions when you’re no longer able to do so.

The two types of LPAs are Property and Finance LPAs which relate to all money matters and can be used while the person still has capacity; and Personal Welfare LPAs which cover decisions on welfare and health matters and can only be used after the person has lost capacity.

LPAs are recognised by financial institutions, tax, benefits and pensions authorities, care homes and local authorities.

You can choose anyone over the age of 18 whom you trust to be your Attorney, provided they are not bankrupt and are happy to take on the responsibility. You can decide which decisions the person will have the legal right to make or to allow the individual to make all decisions in your best interests.

How Is An LPA Set Up?

LPAs can be relatively straightforward to create, although it’s advisable to seek professional advice from a solicitor especially if you want to put particular restrictions in place regarding what your chosen Attorney can and can’t decide.

Lasting Powers of Attorney are important documents so it’s worth ensuring you get yours just right. By using a solicitor to advise you and to check the contents of your LPA before you have it signed by a Certificate Provider, you could save your chosen Attorney(s) a great deal of potential difficulty in the future.

For more information on Lasting Powers of Attorney or for professional legal advice on setting an LPA up, contact our solicitors on freephone 0800 988 3674 or 01244 311 633 or email advice@bartletts.co.uk

Bartletts Solicitors help pensioner thrown to floor on bus

Bartletts personal injury lawyers in Chester recently helped a passenger secure compensation for personal injuries after he was thrown to the floor on a double decker bus.

While there are many rules and regulations for public transport, there are still a number of road traffic accidents that involve buses in the UK each year. In many cases the bus itself may not damaged at all, but passengers can still suffer painful injuries especially if they are standing or there are no seatbelts provided.

This was the case for one 60-year-old retired gentleman who was making a routine local journey on a double decker bus. Suddenly, a van emerged from a side road and caused the bus driver to take evasive action and swerve to avoid hitting the van. The pensioner, who was seated at the time, was thrown forward by the jolt and hit the floor with force.

The gentleman, who was in considerable pain and shock, was taken to the local hospital. He was given a full screening and assessment, and was diagnosed with severe soft tissue strains to his legs, arms and neck. The man was then told he would need a full course of physiotherapy to help him recover his full mobility again.

When the 60-year-old man came to see one of our specialist personal injury lawyers, he was still suffering from insomnia and was now nervous when travelling on a bus. We immediately set out about helping him find a road to recovery. At Bartletts we always pride ourselves on providing a personal service and we were happy to be the main point of contact with the pensioner’s rehabilitation provider to ensure his recovery progressed in the best possible way.

It took nearly two years for the gentleman to recover from all his accident related symptoms, during which time we worked hard to establish his claim for compensation from the bus company’s insurance provider. Once we knew the full extent of his injuries, we successfully secured the correct level of compensation for personal injuries, and negotiated an extra amount to reimburse his travel expenses for medical appointments and physiotherapy sessions.

Compensation for lost finger in faulty machine

It is every employer’s responsibility to ensure that their staff are safe in the workplace, especially when it comes to dangerous machinery. So when a production operative was injured at work by a faulty machine, Bartletts expert personal injury lawyers in Wrexham quickly helped him secure the compensation he deserved.

The 40-year-old man was operating a printing machine, which he did every day as part of his job. However, the guard on the printing machine was broken and his hand became trapped. The man was in incredible pain, his hand being so badly crushed that he had lost the top half of his index finger on his left hand.

He was immediately taken to the accident and emergency department at his local hospital. He received surgery to his amputated finger, which could not be saved above the knuckle.

Not only was he unable to work after the accident, but he also required help with everyday chores while he recovered. He was left with ongoing difficulty gripping and the loss of his finger damaged his confidence.

When the gentleman came to see one of our specialist personal injury solicitors, he told us of the ongoing pain that he was suffering from. We quickly got to work on his case and discovered the employers knew that the guard was broken and had failed to address the issue. As a result, we successfully secured an advantageous settlement for personal injury, and compensation for loss of earnings, from the employers insurance company.

Compensation for child knocked over by car

When a child was knocked down by a car, Bartletts personal injury solicitors in Wrexham were able to help her parents claim compensation for personal injury on her behalf.

The seven-year-old girl was walking with her parents when she ran in between cars onto a busy road. She was knocked over by the impact of a car, seriously injuring her leg. The little girl, who was in a lot of pain and very distressed, was rushed to the accident and emergency department at her local hospital where she was taken for an x-ray.

The girl and her parents were told she had broken her leg and it would require a plaster cast. For several months after the accident, the young girl needed constant care and assistance from her parents as her leg recovered. As well as the difficulty of getting around on crutches, the girl also suffered physiological trauma after the accident.

When accidents such as this happen to children so young, it can be difficult to tell the long-term impact of their injuries, so it is always a good idea to get legal advice.

In this case, the young girl’s parents came to see Bartletts Solicitors and our expert personal injury lawyers for advice on making a claim. Although liability on cases such as these can be difficult to prove, our team successfully pursued the driver and his insurance company. We then negotiated compensation for personal injuries on behalf of the seven-year-old, to cover pain and suffering, care and assistance costs, and pay for treatment for her psychological symptoms.

Bartletts Solicitors swiftly worked to help the little girl get the compensation she deserved after going through such an ordeal.

The settlement was approved by a judge and the money invested for the child, earning interest, until she is 18 years of age.

Compensation after head on car collision

When an innocent driver was hit by another car in a head on collision, Bartletts personal injury solicitors in Chester not only helped her claim personal injury compensation but we also helped her get rehabilitation therapy for the mental trauma she had suffered.

The 50-year-old woman was driving her car down a main road, within the 50 mph limit, when an oncoming vehicle veered across the road and collided with her head on. The oncoming car hit the woman’s vehicle with such force that her car rolled over three times and then struck a tree.

An ambulance was called to incident, where the woman was suffering from terrible pain throughout her body. She was rushed to the local hospital, where she was examined and treated for severe soft tissue sprains to her knee, back, neck and right foot. The woman was given an MRI scan to her right shoulder to exclude the possibility of a rotator cuff tear. She also had an x-ray taken of her right foot to make sure she had not suffered any fractures.

The accident seriously affected the lady, for some time after. Not only was she left with a permanent scar to her forehead, but she was also in a severe state of shock for some time after the accident. We arranged for her to receive cognitive behavioral therapy to try and come to terms with the accident.

When the lady came to see one of Bartletts experienced personal injury solicitors, we understood how difficult is to recover from an accident like this and quickly got to work to get her the compensation she deserved. We carefully investigated the accident and successfully won compensation for personal injuries, medical treatment and rehabilitation, and travelling expenses.
